Levant Web Studio / Levant Link
Terms & Conditions
Our terms of service for client projects, digital profiles and products, alongside the rules for using our websites. They explain what each of us agrees to do and what happens when plans change.
Last updated 12 October 2026 · LEVANT WEB STUDIO PTY LTD · ACN 698 642 956
A one-off project normally starts with a 50% commencement payment after quote acceptance. It is non-refundable for a change of mind to the extent of reasonable work and commitments. We account for those costs and return any excess. Serious hardship may qualify for a pause or an exceptional arrangement, and your legal rights always remain.
1. Who these terms cover and how we agree
These terms apply to services and products supplied by LEVANT WEB STUDIO PTY LTD (ACN 698 642 956), trading through Levant Web Studio and Levant Link. The same company invoices work under both brands. We, us and our mean that company; you means the person or business named in the accepted quote or order.
Our written quote or order summary sets out the specific deliverables, price, payment milestones, included revisions, expected timing, hosting or support arrangements and any third-party charges. We make these terms available with the quote. An agreement begins when you accept the quote in writing and we confirm it, or when you pay an invoice after receiving both the quote and these terms. The person accepting for a business confirms they are authorised to do so.
If documents conflict, an expressly agreed special condition in the quote takes priority, followed by the quote, the agreed scope and then these terms. We change an active project only by written agreement. A later update to this website page does not silently change an existing agreement.
2. Discovery, quotes and previews
Enquiries and quotes are free unless we say otherwise in advance. For a Levant Link digital profile, we show you a simple template or demo-site preview before asking you to commit or pay. It indicates the proposed direction and may contain placeholders. A fuller concept, strategy or prototype is included only when the quote says so.
We may offer a preview for another type of project, but a preview alone does not oblige either party to proceed. You may share it internally to decide whether to engage us. You retain all rights in material you supplied; we retain rights in our unpaid concepts, templates and demo work.
3. What we will deliver
We will provide the work described in the accepted quote with due care and skill. The scope may cover websites, landing pages, digital profiles, copy, logos, brand assets, booking or enquiry integrations, automation, SEO, domains, hosting, care plans or custom NFC goods. A service mentioned on either website is included only if the quote identifies it.
Please check that the quote lists the pages, features, platforms, integrations, file formats, content responsibilities, revisions and any ongoing costs you expect. If you request a change, we will explain its effect on price and timing and obtain your written approval before charging for it. We may use suitable contractors and tools to perform our work while remaining responsible for our obligations to you.
We may use AI-assisted tools in research, drafting, design or development. We review the work we provide. You should still review and approve final business-specific facts, claims, policies and contact details before publication. We do not provide legal, tax or regulated industry advice unless expressly engaged and qualified to do so.
4. What we need from you
You will nominate a contact who can provide decisions, content, access and approvals; respond within the periods reasonably stated in the project plan; and give us accurate, lawful material in usable form. You confirm that you have permission to use and provide all supplied text, images, logos, testimonials, personal details and other content, including permission from people featured in a public profile.
You are responsible for your products, pricing, customer promises, regulated claims and legal notices that you supply or approve. Tell us about accessibility, privacy, security, compliance, payment, booking or recordkeeping requirements that apply to your business before we scope the project. We will flag an obvious issue we identify, but a general website project does not include a legal compliance audit unless the quote says so.
You remain responsible for activity in accounts you control, protecting your credentials and promptly removing access when no longer needed. Do not provide unlawful, infringing, deceptive or malicious content. We may decline to publish it and will explain why. We will cooperate on a reasonable, lawful alternative.
5. Timing, review and approval
A project schedule begins when we have the commencement payment, materials, access and decisions needed for the relevant stage. Dates described as estimates may move if those inputs, agreed changes or third-party services cause delay. We will tell you promptly about a material delay and agree a revised schedule. A fixed deadline is binding only when expressly stated in the quote.
Unless the quote states otherwise, a website project includes two consolidated rounds of substantial revisions within its agreed scope. Correcting our error against the scope does not use a revision round. The quote should specify any digital-profile or physical-product revision allowance. We will quote for extra work before starting it.
We will give you a reasonable chance to review the work. Your written approval authorises launch, handover or manufacture of the approved proof. We will correct errors we introduced at no extra charge. If you delay approval or material for an extended period, we will discuss a new schedule or the hardship and closure process below rather than treating silence as approval.
6. Prices and the commencement payment
The quote states the total price, whether GST applies, and any disclosed third-party charges. We do not add undisclosed fees. For a one-off project, 50% is payable after you accept the quote and before substantial production begins; the remaining 50% is due when the agreed work is ready for final review and before launch, final handover or production and dispatch of custom goods, unless the quote specifies different milestones.
The 50% commencement payment is credited toward the total project price. It reserves production capacity and funds planning, setup and early work. It is non-refundable when you simply change your mind, to the extent it reasonably covers work performed, capacity specifically reserved and not reasonably reallocated, and non-recoverable project costs. On cancellation we will stop avoidable work, provide an itemised accounting and return any amount paid above those reasonable amounts. We will not automatically retain the whole 50% if the work and commitments do not justify it.
A change of mind does not remove a remedy available for our breach, a failure to supply, or a consumer guarantee under Australian law. If we are unable to supply the agreed work, we will account for completed work and refund the unused portion as required by law. We will discuss a genuine invoice dispute in good faith. For an undisputed overdue amount, we may pause new work after written notice and a reasonable opportunity to pay.
7. Serious circumstances and project pauses
If a serious event affects your ability to continue, email us to request a pause. Examples include bereavement, a family emergency, serious illness or injury, a car accident, separation or divorce, or a comparable disruption. You need not provide sensitive documents as a routine condition; tell us how to contact you and, if possible, when you expect to resume.
For an active one-off project, we offer one pause of up to 90 days without a restart fee. Paid amounts stay credited to your project. The work and schedule pause, and we will agree a realistic restart date based on availability. Any separately purchased domain, website hosting or third-party service you ask to keep running may continue to incur its disclosed charge. Levant Link digital profiles currently have no separate hosting or care-plan charge.
If continuing is impossible because of the serious event, contact us. We will consider an exceptional cancellation or partial refund fairly, taking account of the work completed, reserved capacity, recoverable expenses and your circumstances. We may agree to refund more than the change-of-mind calculation would require. Your statutory rights always apply.
We may agree to a longer pause. After 90 days without contact, we will give at least 30 days written notice to resume, extend or close the project. Any closure includes the accounting in section 6. If a serious event on our side causes a substantial delay, we will offer a revised schedule; if it does not work for you, you may end the affected work and receive the refund required for services not supplied.
8. Cancellation and ending work
You may cancel a one-off project by email at any time. We will stop avoidable new work and give you an itemised statement of work performed, reasonable reserved capacity and non-recoverable commitments. Amounts already paid are credited against that statement. If a further amount is properly due, it will not exceed the agreed price for the affected work. We will return any excess. Sections 6 and 7 govern change of mind and serious circumstances.
Either party may end the affected work for a material breach that the other party does not remedy within 14 days after written notice describing the issue, unless the breach cannot reasonably be fixed or immediate action is required for safety or law. We will account for work and payments fairly and preserve rights provided by law. We may suspend a hosted page immediately where reasonably necessary to address a serious security threat or unlawful content and will notify you as soon as practicable.
Ending an agreement does not erase accrued payments, confidentiality duties or rights in work already supplied. We will reasonably assist a transition in line with the quote and the handover provisions below. Any new migration work will be quoted before it begins.
If an event outside either party’s reasonable control materially prevents performance, the affected party will notify the other promptly, take reasonable steps to reduce the impact and resume when practical. If it continues for more than 60 days, either party may end the affected service by written notice. We will account for work supplied and refund prepaid amounts for work that cannot be supplied, subject to rights under law.
9. Ownership, licences and portfolio use
You keep ownership of material you provide. You give us permission to use, edit, store and display it as reasonably needed to deliver and support the agreed work. You confirm you have the rights needed to grant that permission.
Once the relevant one-off price is paid in full, you own the final custom text, logo, artwork and site or profile files we created specifically for you, to the extent we can transfer those rights. The quote defines the files and formats included in handover. Our pre-existing templates, reusable components, tools, systems, methods, draft concepts and rejected designs remain ours; you receive a continuing licence to use any such element embedded in the paid final work for its intended operation.
Third-party fonts, images, themes, software and integrations remain subject to their own licences. We will identify material ongoing licence costs we know about before you accept the quote. We do not transfer a third party’s intellectual property or our brand domains. We will ask permission before using your logo, testimonial or non-public project details in a case study or marketing feature.
10. Domains, website hosting and care plans
The quote identifies who controls and pays for each client-specific domain, hosting account, software licence and integration. Where we register a domain for you, we will use your nominated registrant details where permitted unless we clearly agree otherwise. You are responsible for renewal charges and maintaining accurate registration details where the domain is yours. Our domains, including levantweb.com.au and levantlink.net, remain ours.
A separately purchased website hosting or care plan includes only the support, updates, backups and billing period stated in its quote. A fixed term does not automatically renew unless the quote prominently says so and you agree. A month-to-month plan may be cancelled by email before the next billing date, taking effect at the end of the paid period. We will disclose any different minimum term or notice period before purchase.
We will use reasonable care with services we manage. Third-party registrars, hosts, email providers, APIs, booking systems and payment services have their own terms, pricing and availability. We will tell you about a material issue we learn of and take reasonable steps within our agreed scope. We cannot promise uninterrupted availability or a particular security or sales result. If a hosted website ends, we will give reasonable notice, allow a reasonable opportunity to move it and provide your supplied content and the agreed exportable deliverables on request within 30 days after the end, unless urgent security or legal action is necessary.
You remain responsible for copies of business-critical data in accounts you control. Backups, incident response, ongoing edits, plugin updates and security monitoring are included only where the quote says so. We will not hold your client-owned domain or paid custom deliverables as leverage over a genuine dispute, subject to rights over unpaid work.
11. Levant Link digital profiles and NFC goods
A Levant Link digital profile is currently a one-off purchase. We host the completed profile at its Levant Link address without a separate hosting or care-plan charge. A profile address on our domain is a service address, not a sale of the domain or subdomain. Later client-requested changes are included only if agreed in the quote or separately approved; we will correct our own errors at no extra charge.
Free profile hosting is not a promise of perpetual operation. We will not start charging an existing client for it unless that client expressly accepts a new written offer. If we discontinue free hosting, we will give at least 60 days written notice where reasonably practicable, and make a usable export of the client-specific content, supplied assets and available static page files free of charge before taking the profile offline. You may request an export earlier. Our brand domain, platform and reusable systems are not transferred. Urgent safety, security or legal issues may require earlier suspension with prompt notice.
For custom NFC cards, keychains or other goods, the accepted order identifies the material, quantity, artwork, destination, price and delivery charges. We ask you to approve the final proof before production and test the programmed destination where reasonably practicable. Tap behaviour depends on the device, settings, tag and destination link. A personalised item already in production need not be returnable merely for a change of mind, but we will provide the remedies required for a defect, incorrect manufacture or other failure under Australian Consumer Law.
A physical NFC item that points to a Levant Link profile depends on the destination remaining live. We will explain that connection before purchase. If hosting later ends, an export will be available as described above; a locked or printed item may need separate replacement or reprogramming.
12. Confidentiality, data and security
Each party will use the other’s non-public business information only for the project and protect it with reasonable care. Disclosure is permitted to people who need it to perform the work and are subject to suitable confidentiality duties, with permission, or where law requires. Information already public through no breach is excluded.
We will use reasonable measures to protect project credentials and data we control, and tell you promptly if we become aware of a material security incident affecting your project. You should provide access through suitable accounts and revoke access when it is no longer needed. If your project requires special handling of sensitive personal information, we should agree those requirements in the quote or a separate written data arrangement before collecting it.
A separate privacy policy should explain how we handle enquiries, analytics, cookies and profile information across the brands. This agreement governs project responsibilities and does not replace that policy.
13. Results, limitations and fair responsibility
We will carry out agreed design, development, SEO, automation and support work with due care and skill. Search rankings, leads, sales, conversion rates and uninterrupted third-party services depend on factors outside our control, so a particular outcome is guaranteed only if the quote expressly states one. You remain responsible for checking that your business processes and approved content are suitable for your use.
If a third party claims that content you supplied infringes their rights or is unlawful, you will reasonably assist us and cover reasonable, proven loss caused by your breach of the permissions you gave us, to the extent the law allows. We remain responsible for loss caused by our own breach, negligence or infringement in material we create. Neither party is responsible for the other party’s fault. We will give prompt notice of a claim and a fair chance to participate in its resolution; neither party may settle a claim on the other’s behalf without written agreement.
To the extent law permits, neither party is liable for remote or unforeseeable loss caused solely by events outside its reasonable control. We do not exclude liability that the law does not allow us to exclude. Our goods and services come with consumer guarantees where applicable, including remedies for a failure to meet them. For a major service failure, you may be entitled to cancel and receive a refund for the unused portion or compensation for reduced value; for a minor failure, you may be entitled to a correction within a reasonable time. Other rights may also apply.
14. Using our websites
You may browse levantweb.com.au and levantlink.net, view demo pages and contact us for lawful purposes. Do not disrupt the sites, introduce harmful code, seek unauthorised access, impersonate someone else or use another person’s details without permission. Our site content, branding and code belong to us or their respective owners. Browsing does not grant a licence to copy them commercially; content on a client page may belong to that client.
External links lead to services we do not control. General website descriptions are information about what we offer; the accepted quote identifies what you actually buy. We may update these website-use provisions by posting a dated version, while an existing paid agreement changes only by written agreement or as required by law.
15. Concerns, notices and governing law
Please describe any problem to [email protected] so we can investigate and propose a fair remedy. We will respond within a reasonable time and try to resolve disputes directly. This process does not stop either party from using a court, tribunal, regulator or other legal remedy.
Project, pause and cancellation notices can be sent to [email protected] and the client email in the quote. Please keep your details current. If any term is unenforceable, the rest continues to the extent lawful. These terms and each accepted quote are governed by New South Wales law, subject to any non-excludable right to bring a claim elsewhere.
